# Copyright, and how to report an infringement

**This is a draft and has not been reviewed by a lawyer.** Two things must be
settled before it is relied on: the designated agent below, and whether the
safe harbour named below is the right one. Both are marked.

## What this service does with mods

The mod directory **stores a description and a link**. It does not store, host,
copy or serve any mod file. A mod's file sits on a server its author chose, and
downloading one is a request from you to that server — this service only told
you where to look, and counts that it did.

That distinction matters for what can be done about an infringement:

- **We can remove a listing.** That takes the mod out of the directory, so
  nobody finds it here.
- **We cannot remove the file.** It is on somebody else's server. Only that
host can take it down, and a notice to us does not reach them.

> **[FOR LEGAL REVIEW]** Because this is a directory of links rather than a
> store of files, the relevant US safe harbour is likely **17 U.S.C. § 512(d)**
> (information location tools) rather than § 512(c) (hosting). The procedure
> below is written to satisfy either. A lawyer should confirm which applies and
> whether the agent registration below is required in this form.

## Reporting a mod that infringes your copyright

Send a notice to the designated agent:

> **[TO BE FILLED IN BEFORE THIS PAGE GOES LIVE]**
> Designated agent: **[NAME]**
> Address: **[POSTAL ADDRESS]**
> Email: **[EMAIL]**
>
> A designated agent must also be **registered with the US Copyright Office**
> (dmca.copyright.gov) for the safe harbour to apply. That is a filing with a
> fee; it cannot be done by writing a name here.

Your notice must include all of the following. A notice missing any of them is
not effective, and we will say which part is missing rather than ignoring it:

1. A physical or electronic signature of the copyright owner, or someone
   authorised to act for them.
2. Identification of the work you say is infringed.
3. **The mod id**, as shown on its listing — for example
`com.example.better-ai` — so there is no doubt which listing is meant.
4. Your contact details: address, telephone number, email.
5. A statement that you believe in good faith that the use is not authorised by
the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate, and **under
penalty of perjury** that you are authorised to act for the owner.

**Do not send a notice about something you do not own.** Misrepresentation in a
takedown notice carries liability under § 512(f), including for the other
side's costs.

## What we do with it

We remove the listing, and we tell the author what was removed and why,
including a copy of the notice. We do not tell you who the author is.

We do not judge whether a claim is right. We are not equipped to, and a
directory that decided copyright disputes would be deciding them badly.

## If your listing was removed and you believe that was wrong

Send a counter-notice to the same agent, containing:

1. Your signature.
2. The mod id that was removed, and where it appeared.
3. A statement **under penalty of perjury** that you believe in good faith it
was removed as a result of mistake or misidentification.
4. Your name, address and telephone number, and a statement that you consent to
the jurisdiction of the federal court for your district — or, if you are
outside the United States, of any district in which this service may be
found — and that you will accept service from the person who filed.

We forward the counter-notice to the person who complained. If they do not tell
us within **10 to 14 business days** that they have filed an action, the listing
may be restored.

## Repeat infringers

An account whose listings are removed repeatedly on valid notices loses the
ability to publish. That is a restriction on publishing only: the account keeps
working everywhere else in the game, because being unable to publish mods and
being unable to play are different things and should stay different.

## Trade marks, and somebody else's mod

Neither is a copyright matter and neither belongs in a DMCA notice. Both are
covered by the modding guidelines — *"Publish your own work"* — and are handled
by an ordinary report from the listing's page, which is faster.
